Legal Question in Immigration Law in Nevada
Married to a felon
Hi,
I recently married a USC which I have been seeing for almost two years. She went to Florida and said she needed to take care of some business. I was expecting her to come back soon so we can live together. However, I just found out that she is not coming back for she was arrested and is now in prison. I am a Canadian and currently has no status. She said she was sorry and still wants to remain married to me. Is she still eligible to file for my petition? Please advice.

Yes...I do not see any problem with her starting the petition for you. You need to gather lots of documents. Her birth certificate or naturalization certificate, your marriage certificate, etc. are needed. Were any of you married before? If so, copies if divorce decree is also needed.

I will need some further details from you, but you may be able to proceed with the petition. If you would like to contact me we can discuss your situation.
Best wishes.
