Legal Question in Immigration Law in Nevada
Unusual circumstance
My fiancee has been in the U.S. for approx. 20 yrs. He came to this country illegally. He used another person's identity to get a job here. He got caught and was told that he could not apply for a greean card. At the time he had an existing work permit under his real name and therefore remained working in the U.S. About 6 years ago, immigration informed him they could not renew his permit any more. We are engaged to get married now and I was wondering if the past situation will effect him being able to become a resident. How long does this procedure usually take? I am an american citizen and I don't know how go about finding out the cicumstances for this situation.

I strongly suggest that you consult with an immigration attorney, and provide copies of all paperwork your fiance has related to his prior work permit. Hi and Good Morning,
Due to the length of time that he spent in this country, the first thing that I would do is order his file from the immigration service through as procedure called FOIA. Upon receipt of the file, I will be able to determine if there is anything that could protect him using any older legislation.
You see since he is illegal and entered illegally, even marriage to a US Citizen will not help him at this time, there might be some options of course but I will need to research the individual situation.
