Legal Question in Insurance Law in Nevada
fire insurance responsibility
Our homeowners board has the insurance on the outside of our condo. The insurance company will rebuild to the original construction. We were told to have insurance for our personal property and any additions and remodeling. The 4 plex of which 1 is ours burned down. The insurance company put into the contract that Asbestos clean up is not insured. We were never told this nor to have additional coverage for this loss at any of the yearly homeowners meetings by the insurance representative. Now the homeowners board is saying the 4 units have to pay for this asbestos clean up. We were repeatedly told what insurance we needed to carry and it was never mentioned that we had to have insurance for asbestos removal. The insurance contract is available to viewing for all the members of the complex.

Re: fire insurance responsibility
Since most modern insurance casualty policies do not cover asbestos removal this is not surprising. I doubt if you would have been able to get the coverage either yourself or through the homeowner's association.
