Legal Question in Intellectual Property in Nevada
New Website Idea Need some guidance
I have a new website idea. I am not an internet savy person. I need to know if I should start by securing a domain name and getting a quick, inexpensive site up and running or should I consult an attorney. If so, what will we discuss and what are some potential pitfalls I need to protect myself from. Do I incorporate? How do I protect my ideas and my site's concept? Are there any attorneys that specialize in this field?

Funny you should ask. I have been practicing in the area of Internet Law the last 10 years. We should discuss your business plans and I can lay out the variety of issues you should address. If you email or call I would do an intitial consultation without charge.

I don't know how to answer this since there is no specific information. I have multiple sites and property is protected the same as if you were publishing in print and on paper. Whether you should incorporate or not is a decision you should make with your accountant and an attorney. It really has nothing to do with the website. If you start your business now without incorporating, and choose to incorporate in the future, you can always assign your intellectual property, good will, websites, etc. to the corporation and simply continue the business without a hiccup. Depending what you are doing with your site, you should perhaps have some special legal disclosures, limitations of warranty or liability, etc. posted on your site. Again, though, this would not be much different from any other media of advertising.
