employers outlawing gratuity

Many employers in Las Vegas disability and senior related services have policies that forbid employees to accept gratuity under penalty of dismissal. Is this legally binding?

I do not have a clear answer for you. Generally, an employer can discharge for any reason, good or bad (employment at will). I am unaware of any particular statute in Nevada that prevents this policy. An employer may not keep tips, nor may the minimum wage be lowered because an employee gets tips in Nevada. While you could argue the poliy you are talking about is unfair, I am unsure if a Court would agree. The employer would probably argue it is a legitimate business decision and that they want to keep disabled/elderly persons from being possibly taken advantage of or compelled to give tips for services.
