Legal Question in Employment Law in Nevada
I am a truck driver for a large food service company in Reno, NV. On October 21, 2011 I was working in the warehouse on light duty when one of the managers came to me and said HR came back to the warehouse and wanted me to clean up a spill in the womens bathroom in the front office. The manager came with me to the bathroom and the spill was blood. The blood was around the toilet and out to the bathroom door and it appeared to be from a womens menstrual cycle. The manager gave me a mop bucket and a mop and I cleaned it up. I was not given any protective clothing or gloves. I just was told that this is a serious work place violation because of the risk of blood diseases. Can you tell me what I can do or if I have case against the company. HR, the manager that accompanied me to the bathroom and a sales lady witnessed what was in the bathroom.

If you were harmed, you might have a case. For example, if you have contracted HIV or Hep C as a result of mopping up blood in the womens' restroom, then you probably have a strong case. On the other hand, if you were not harmed, then you do not have a case worth pursuing. If you want to help your company, perhaps you could bring the proper procedures to the attention of HR, either directly or by and through an anonymous letter.
