Wrongful Termination
I was recently recruited from a job of 5 years to my new position, a salaried manager in training. After @ 4mths. into training I received a binder to map out my training I was unaware I was suppose to receive. It was a hot day in Las Vegas @110, I was working an outside rotation where I was on an asphalt lot for the majority of my workday, we had a work area that was shaded, but also had chairs, a refrigerator, a time clock. I sat down to take a short breather and was reading an article on Las Vegas in the Time. I either fell asleep or passed out from the heat for a short period @ 2min. time. At that time a manager walked in and waved his hand in front of me, I looked up at him and he asked me if I was sleeping, I stated probably I'm not sure but I was out of it, that's why I don't read. He stated that it was not good that I did this in front of co-workers and I stated I know that I was sorry that it was not like me. Nothing else was mentioned for over a 24hr. period. Then I was pulled in the office with that manager and another and he stated that the company does not view this lightly and that he was partnering with HR and I would be on admin. leave until he heard back. I do not, generally, assist in wrongful termination matters. I would just note that, at least in Nevada, there is no general right to not be "wrongfully" terminated. Just because an employer acted stupidly, or without good reason, to discharge an employee, without more (such as a race/religion/age discrimination issue, or a violation of union or other contract) there is generally no legal claim (except perhaps for unemployment benefits)
