Legal Question in Landlord & Tenant Law in Nevada

judgment from attorney

an attorney is attaching my wages from a case in 1998 where he represented my husband and i in a case against a landlord regarding cables under the house. we lost and were to pay $20k. (11 to landlord + 9k for attorney fees). i paid the 9 + 1 towards attorney fees and my x-husband was to cover the rest of the attorney fees. he died with $6.73 to his name in dec, 07 and i received the judgment in feb. 08. i barely make minimum wage myself and have 2 daughter's in college. after i paid my portion of the debt, i never heard another word until feb, 08 because he was only in contact with my x at that point. we divorced in 1998 and lived separately since then. i never received one single invoice to my residence and my x never mentioned it to me. i work full time + and can not take off work to fight this guy. if i were to file a bankruptcy, could i include this? do you know of any other options i might have? this all went on in reno, nevada

Re: judgment from attorney

In CA, at least, there's a requirement that the attorney notify the former clients of a dispute and a right to non-binding arbitration. I don't know what the law is in NV.

If you qualify for a bankruptcy, general unsecured debts are dischargeable. There are some exceptions, but this doesn't seem to fit into any exception to discharge. You should speak with an attorney in your area.
