my mother's property

my mother's landlord started eviction procedings because she hadn't paid her rent. she was in an accident and i informed him the rent would be delayed because she was in the hospital. he was okay with this, but three weeks later he locked up the house and took her belongings. we live in nevada and i don't know if he had the right to take her things. i sent him a letter requesting to retrieve her stuff and set up a payment plan and he called me to say he had taken her stuff and there was no need for me to contact him again. does he have the right to take a house full of stuff and refuse her the right to get her clothes or anything?

Thank you for your inquiry.

It is hard for me to determine if the eviction proceedings against your mother were legal. However, if the landlord had proper grounds to evict your mother, Nevada law requires a landlord to properly store a tenant's property for 30 days for retrieval. After 30 days, they may dispose of the tenant's property as they see fit.

If the landlord has wrongfully disposed of your mother's property, you would have the ability to bring a civil action against the landlord for the fair market value of your property lost.
