Legal Question in Medical Malpractice in Nevada

State board of medical examiners disciplinary action as evidence in civil case.

Is disciplinary action against a physcian by the state board of medical examiners useful in a civil case if it is a result of the actions that led to that case. Would it be considered predjudical.

Re: State board of medical examiners disciplinary action as evidence in civil ca

A determination of wrongdoing by the Board of Medical Examiners is useful to the successful conclusion of a case whether or not it is admitted into evidence. However, such findings are rare and the Board usually takes no action even upon the successful prosecution of a civil case.
