Legal Question in Personal Injury in Nevada

Auto Accident Personal Injury Compensation

My boyfriend was hit from behind in his vehicle by a cab driver who was faulted at the site. Police report confirmed as did witness. Severe shoulder injury resulted in major surgery. Accident occured July 2001......Question: TO date NO compensation of any kind has been received. Unable to work, with NO income, shouldn't he be entitled to some sort of financial compensation?? Nearly a year has passed and he has received nothing. Shouldn't he be entitled to something? He is a homewoner with housepayments, utility bills, child support and now hospital bills to pay because of this accident. I feel he must surely be entitled to something. Am I right?

Re: Auto Accident Personal Injury Compensation

Based on the facts you have given, you are absolutely right! The insurance claims process is difficult and time-consuming, but to get full value for his injuries, your friend should definitely consider locating a personal injury attorney who will take the case on contingency (i.e., the lawyer gets paid when your friend gets a settlement or judgment on the claim). The process of documenting damages and arguing their value is one that is best handled by a professional who has experience speaking with insurance adjusters and claims managers. There are many opportunities for small mis-steps that can cost a lot in the bottom line recovery. Be aware that the Nevada statute of limitations for a claim in negligence (the nature of this suit) is two years from the occurrence. Your friend needs to get hustling with a carefully worded and well-supported demand to the insurance company of the cab company. I would be happy to help, if you wish to pass on my contact info to your pal.

Re: Auto Accident Personal Injury Compensation

If your boyfriend was hurt in the accident and the accident was not his fault then he is absolutely entitled to compensation for his pain and suffering and reimbursment for his lost wages and medical bills. There is a two year statute of limitations in Nevada for personal injury cases. Please have him contact me immediately.
