Are the medical bills - paid and outstanding - part of the settlement amount or seperate from it?

It depends. Generally, if your state has a No-Fault policy provision the medical bills are typically paid until you go for your independent medical examination and they decide to cut your benefits. When they cut your benefits you may have to treat with a lien. If you have a lien that must be paid from your settlement proceeds, typically, the lawyer will negotiate the lien within the amount the case is settled for.
