injured skating at local rink
Fell while skating, leg broken. Rink took information regarding accident and then went to hospital. Patient will need surgery and will miss at least 4 months work. Is the skating rink liable for the resulting expenses and missed earnings?

The answer is: It depends. Did you just slip on the ice or was there negligence on the rink's part, ie. was the ice uneven, melted, was there debris on the ice that caused you fall, etc. Please feel free to contact me.

Before the rink could be held responsible for the injuries, it would have to be shown that there was some sort of negligence on its part. This means: (1) that the rink owed a duty to its patrons (e.g., to provide a safe environment); (2) that it breached that duty (by allowing a dangerous condition or failing to remove a hazard); (3) that such breach was the cause of the injuries, and; (4) that damages did, indeed, result. Some possible examples of a breach of duty could be failing to properly groom the ice, allowing too many people on the ice at once, neglecting to remove a rowdy and dangerous patron, or not repairing a dangerous condition on the premises. A plaintiff would have to show such a breach by a preponderance of the evidence to have a case against the ice rink. If the rink is run by a municipality, there may be certain government immunities that apply, as well.

The rink, the manufacturer of the skates, or others may be responsible. There may be insurance coverage to pay your medical bills even if the rink is not responsible.
