How long can our lawyer keep the settlement check?
State of accident - Nevada
My husband was involved in an auto accident two and a half years ago. He was the passenger in a vehicle and the accident was caused by the other motorist. To make a long story short he had to have two knee surgeries and extensive physical therapy. Our lawyer finally reached a settlement with the driver's insurance that caused the accident, but that was 6 months ago and he still hasn't paid our medical liens or given us any money. He is saying that now he is trying to get a settlement from the insurance for the person that was driving the vehicle my husband was riding in. My question is there a time limit to how long he can hold on to our settlement check before paying our liens and us? Also even if he still has a settlement pending with the second insurance is there anything that would stop him from being able to split up the settlement from the first insurance?

there MIGHT be reasons they are waiting to do a disbursal, but usually the disbursal should occur right when the settlement is received.

If the accident was 2.5 years ago; I hope he filed a law suit to protect your statute of limitations. If he didn't file you may have a major problem because you only have 2 years to bring an action or you can't bring it after that time. If seems like 6 months is a very long time to hold your money. I would demand to know what is going on and that they distribute the money or a part of it. IF you have more questions my phone number is 454-2111.
