These are tough cases. It ultimately comes down to what a jury would decide. If a jury decides that you are more than half at fault for not watching where you are going you lose. If you are no more than half at fault you win. However, to make KFC at fault you have to show why they were negligent. This depends on many factors such as did it happen in the day or at night, what was the lighting? Personally, I think they should have painted the speed bump. But, it is hard to say if a jury will agree. Most attorneys, including myself, are probably not interested in this difficult case that appears not to have a lot damages. KFC will probably deny the claim and it will cost a lot to file suit and move forward.
