Boundary dispute: fence line vs plot measurements
In 1989 purchased 19ac. w/markers on all outside corners and divided into 3 separate parcels. Subdivision took place in 1975 by original owner. Interior fences have always been used to designate property lines between parcels. Prop.#1 7ac. has sold 3 times since we bought it; Prop.#2 2ac. is mine; Prop.#3 9ac. has sold twice since we bought it. All sales have used established fences as property lines. No buyer has ever measured including ourselves. #3 built a garage 5ft off fence line in 2005 but we now find it encroaches about 15 ft into our back yard according to plot plan. #1 now appears to own part of our front yard. #3 has offered to buy for a reasonable sum 20ft. from #1 to give to us and pay for surveying and changing lines. # 1 is asking $35,000 for a 20x800 strip that has been used for a driveway since 1975. We feel he is holding all of us hostage instead of being reasonable. All we hope for is to establish lines the way we always thought they were (by original fences). #1 will not budge on price. What can we do without a big hassle and expense? All of this was an unintentional mistake on the part of us all, however, one wants to benefit from the misfortunes of others.
