Duo names

Can a married person, without legaly asking the court to use their prior married name, sign a legal document using the prior name? A person put their name on a title not using their married name. This is a question to help my daughter.

If the name put on the deed used to be that person's name then she can sign in that name rather than go to court and get permission to sign in her new name.
