Family problem

My Husband and I bought a house with his brother and it is not working out. I just came into money, and want to buy him out and he refuses but can't buy us out.

You need to file a lawsuit, called a Partition action, to force the sale of the property.

You can force the issue by bringing an action to partition the property. Given the nature of the property this will force a sale. Then you can bid against others interested in the property to buy it.

If your husband, you, and his brother are all on the title deed of your home you could file for a formal Partition Sale of the property. The Court would force a sale of the property and allow you the option to bid out on the property. This procedure would allow you to buy out your brother and ensure he received his share of equity from the Partition sale.
