Independant Contractor decides to keep the house

My question is as follows: I signed a contract with an independant contractor who owns land and then he builds the home one wants. My current home is now in Escrow process and the contractor called me and says he has decided to keep the house he's building for me! What can I do in this case? The Contract we signed was not notarized and also he did not require Earnest Monies so escrow has not been open. Do I have rights and should I pursue them or just let it go? Please help! I sold my house to buy this house, everything I own is now in storage, and have no where to live.

It's impossible to give you an answer without looking at the terms of the contract. In general, however, you are entitled to enforce a contract which provides for the sale of real property. The fact that a notary didn't witness the contractor's signature is likely irrelevant. Your remedy here would be specific performance (the Court ordering the sale to proceed per contract) and/or money damages.
