Can a landlord refuse to rent

My landlord has refuse to renew my lease with him. I am a Section 8 tenant and very sensitive to cigarette smoke. I asked to seal out the smoke and this made him mad so he states that he is not goint to rent to me. Can he do this?

Your story seems to indicate what is known as "retaliatory eviction," but the facts do not quite fit the claim. Your landlord is not evicting you, as the lease is ending its stated term. As such, the property owner is certainly entitled to decide whether or not to renew your lease, just as he can decide whether or not to rent the property to anyone else. If your lease was for a specified period, and that period has ended, then he is under no obligastion to renew it, unless the contract reserved a right to you to the contrary.
