Legal Question in Real Estate Law in Nevada
Real Estate Partnership
I own 50% in a rental property, I have found someone that is interested in purchising my half of the rental. My partner is against me selling my half. There is nothing in the contract that states one of us cannot sell our share. Would it be legal to just go ahead and sell my 50% of the rental?

Re: Real Estate Partnership
Yes, but you might get sued anyways. Because the agreement is silent as to the right to sell, your partner might sue you and the buyer. You want to make sure that the buyer does not screw up the partnership and leave you holding the bag to defend a law suit, especially if he has taken property from the partnership.
