Legal Question in Tax Law in Nevada

mariage tax laws due to her being in NV and Iam in CA.

Me and my wife live off separate incomes. She lives in Reno NV and I live in Fairfeild CA because Iam in the military. Can we file a separate tax return due to us living apart. I just don't won't to get pinged by the IRS. If it would help we got married in Oct of 2001 so it has not been that long. Thank you for your time.

You can file separately but I don't know why you would want to do that. Have your tax preparer run the numbers. In general it works to the advantage of the parties to file jointly.

Howdy:

Separate tax returns can always be filed; but the personal exemptions and deductions must be split between the spice.

If you itemize deductions, it will probably work against you to file separate returns.

You canfile separately, but it would be showing as "Married, filing separately", which in most cases will cost you more. Chances are, you will do better filing jointly.

One thing to remember is that on your state income taxe returns, you will only be taxed on the income that was earned in California, and she will only be taxed in Nevada on income she earned in Nevada.
