Usually the person named as executor in the will. If that person doesn't do it or the deceased died without a will, the surviving spouse or children will usually do it. In the event that no one does it, the law allows someone interested in the estate to do it.

This can be a creditor, heir or someone named in the will as a beneficiary or someone related to the deceased.
