A will executor must pay the debts of the decedent from the estate property. Usually this is simple, but it could involve disputing debts or negotiating compromises. (In some case involving a small estate and a surviving spouse or minor children the decedent's creditors may lose their claims.) The executor should file a decedent's tax return if necessary. (This is the federal tax return for the last tax year of the decedent's life.)
The executor must gather assets and distribute or sell them.
The executor must hire an attorney for the probate process. The executor is free to negotiate fees with any attorney he or she is considering hiring.
Then the attorney and executor get the court to approve the distribution of assets.
