Legal Question in Wills and Trusts in Nevada

Finding out what is in a living trust.

My mother is 95. She is forgetful & doesn't understand many things. My cousin interferred and took it upon himself to take my mom to an attorney without my knowledge and set up alivingtrust. I know she did not understand everything,& just trusted my cousin. I am her only child, she lives across the street from me. I have attempted severaltimes to contact her attorney, and he is rude, and very nasty to me. My cousin has told him things which were untrue. At no time was I included in any discussions about this trust. I would like to see these documents, my mother doesn't remember anything about any paperwork that was set up. My cousin had had her financial statements sent to him in Calif. and had me taken off her checking account. I pay her bills and take care of her needs. He isn't even in town. Took me forever to get the checking thing fixed. I was never notified about this either. I have been accused of horrible things and my mother can't remember anything even though I have told her over and over. I just want to make sure everything is in order, and she can't even call the attorney because she cant remember what to say. These people arn't with her 24/7 and think she is of sound mind.

She can't remember anything.

Re: Finding out what is in a living trust.

You should contact Clark County Senior Citizens Protective Services, Public Guardian Office, 515 Shadow Lane, Las Vegas, NV 89106, and report what your cousin did and give Senior Protective Services all of the information about the creation of the living trust and the checking account.

You probably need to file a petition for guardianship of the person and estate of your mother. Expect to pay $3-5,000 to have all of that handled by an attorney.

The forms are online at the Clark County District Court website. http://www.co.clark.nv.us/CLERK/family_forms_library.htm. There is also a self help center at the Family Court on Bonanza/Pecos that can answer questions.
