Re: Living Trust
Do a document entitled Revocation Of _____________ Living Trust dated _________________. Also take all your property and money out of the living trust and put it back in your name.
Re: Living Trust
. . . Or you can replace it with a substitute Living Trust that accurately expresses your changed wishes for disposition of your property. The important thing is that any copies of your revoked trust must be retrieved and destroyed, or your heirs will almost surely end up in probate court fighting over what your true intentions were.
Don't leave any loose ends remaining, including the titling of assets. Either return them to your own name, as suggested by Attorney Smith, or re-title them in the name of the new trust to ensure there can be no dispute about what your wishes are in regard to those specific items.
