Can you go through probate without an attorney, or must you have legal representation?

Probate without an attorney
Although you can represent yourself in probate court, I would not recommend it. If the estate is very small, an attorney can recommend time and money saving procedures, making the fee quite reasonable considering the time, costs and aggravation saved. If the estate is large, the work will be incredibly complex. In addition, the attorney may be willing to wait until the estate closes before requiring payment.
Probate is a fiduciary proceeding. Make a mistake handling money and you could wind up in jail - I saw it happen in probate court last week.
In either case, probate can be enormously complex, so it is not something recommended for the do it yourselfer. However, some people have to learn the hard way.
