Legal Question in Wills and Trusts in Nevada

In settling my mom's estate, there is a death benefit that we are having a difficult time claiming. The estate is in Nevada and qualifies for the small estate procedure with no probate. VOYA, the life insurance company, is requiring a Letters Testamentary. We have been told that this document can only be received through the probate process. Are there any other options that we can try? What are our rights in making claims if the company is requiring documentation that would require considerable effort and/or expense? 8. What is required if the Estate is named as the beneficiary?

Some states allow benefits to be paid under a Small Estate Affidavit if the amount payable is less than a

specified amount. This amount is state specific. If the amount payable is greater than allowed under the Small

Estate Affidavit, we require a Certified Copy of the Letters of Administration for the Estate of the insured. This

is a court issued document and legal representation may be required.
