sons estate

My son passed and had 3000 cash in his apartment and has 1300 vacation pay coming. Do I need to post in the newspaper or just fill out the NRS 146.080. He passed in Las Vegas we live in California We opened an estate account in California.

If the total value of the estate is under $20,000, it can be handled without the formality of a probate. You found the correct statute relating to this, and the Affidavit of Entitlement is not a complicated matter. Note that it will work to transfer the assets to you, as his parent, provided he does not have a child or spouse, at least 40 days have passed since his death, and he held no interest in real estate. If these conditions are met, my firm could prepare the necessary documents in short order. If he died in Washoe County or another part of Northern Nevada, we would be happy to assist you with this matter.

Nevada law would control. However, if the $4,300 is the extent of his estate, there should be some sort of procedure for handling of small estate under NV law as well. In CA, there is no publication requirement for small estates. You should repost, asking the question under NV law.
