No will, a surviving spouse, and probate
My mother's husband passed away without a will. All of their assests, house, bank acct, etc. were in both their names. She was named beneficiary on all documents. His final wishes included no contact with his four children whatsoever. She now is being sued for their''inheritance'', legal access to his cremated remains, and distribution of personal property that was his from a previous marriage. They were married 8 1/2 years. Do they have any legal right to anything he owned? Does everything go to her? If they sue for probate can they win? Thank you.
