Legal Question in Workers Comp in Nevada

Nevada: I was hurt when someone rearended my work truck while I was stopped at a red light (witnessed by three on-duty police officers). Do I have to do anything to keep Workers Comp and this guy's insurance company responsible for future problems down the line?

I assume that you have already filed a claim for workers' compensation benefits (file C-1 Notice of Injury with your employer and visit your employer's workers' compensation doctor and complete/submit a C-4 Claim for Compensation to employer's work comp insurer). If that is the case, and you have an accepted claim for all of the body parts which were injured in the accident you just need to continue to treat through work comp until you have reached "maximum medical improvement."

Also, you have a potential third-party claim against the party who rear-ended you. Keep in mind that you will need to keep track of the statute of limitations which is two years from the date of the accident. In other words, before the two year mark is up you will want to have settled your potential claim with the third-party or file a complaint. It is also important to understand that work comp will have a lien against any potential recovery for the amount of money expended on your behalf under work comp.

Yes. Have you filled out the C-4 form for with your employer yet and have you received treatment yet so the doctor can complete the form? This will be necessary for both of your claims.
