What is the settlement cap
What is the most amount of money allowed for a workmans compensation claim settlement for someone who had a makita saw blade jump off a peice of rebar and cut to the bone thru the arteries and muscles and veins with two subsequent surgeries to correct initial repair?

Hello. I am sorry to hear about your work injury; it sounds very serious.
To answer your question: The max settlement amount you can expect to receive depends on a number of factors in Nevada. First, you must be released "stable and ratable" by your treating physician. Once this has taken place, you should be scheduled for a permanent partial disability evaluation with a Nevada rating physician by the insurer.
The rating physician will examine you and will give you a percentage whole person impairment rating based on specific guidelines set forth in the American Medical Association's Guide to the Evaluation of Permanent Impairment. Once you have been rated and you have been given a percentage of impairment (e.g. 10%) this figure along with your age, average monthly wage and a set factor (determined by the NV legislature) will be used to calculate what your settlement amount should be.
Please know, that you do not have to settle for the first PPD percentage. You can appeal it.
