Breaking a Commercial Lease

I have a 3 yr. lease that I signed which ends 2/2/09. The landlord has not complied with anything in the lease and has allowed such things as extreme noise from other tenants, a leaking roof, I have to clean all common areas, I think I am paying electricity for other floors, he is unreachable and has left the country. This is the cause of the downfall of my business. I would like to break the lease, how can I go about this?

At a minimum you need to put each and every complaint in writing to the landlord. If he fails to take appropriate steps you may claim what is called a constructive evicition. This must be enough to make the property not suitable for occupancy. I suggest that an attorney review your lease and examine the facts in more detail to see if you fit into this category.
