Legal Question in Business Law in New Hampshire

business lease

I leased space in a convience store to sell sandwiches,muffins,ect. I went out of business and used a provision in my lease to get out that said I could pull out within a year and would incur no negitive effects. 3 months later I am trying to get my security deposit back and was told that the cost or repairing the space is equil to the security deposit. My lease does not cover this area. ( painting a wall and removing wall panel that the healh department had me put up. My question is,since I was responsable for fit up is not the next tenent or leeasor responsable for the place after I leave. If I take him to small claimsI stand a chance? It is not alot of money ( $800) but I think I am Right. Am I?

In order to answer your question I would need to examine the lease. Given the amount of money in dispute, the cost for a throrough examination and consideration of the legal rights and remedies might be as much as the amount at issue.

Better show the lease to an attorney before you blithely sue the landlord and find yourself on the receiving end of a counterclaim for unpaid rent, etc.
