Legal Question in Business Law in New Hampshire

Compensation for services rendered following contract termination

We are landscapers under contract to provide services to a condo complex. We submitted a 30-day notice to terminate as provided by our contract. Payments under the contract were equal monthly amounts; however, the work we did wasn't broken out quite so conveniently and we expended many thousands of dollars over and above the payment schedule to satisfy the terms of the contract, especially during the 30-day notice period. We notified the complex at the beginning of the 30-day period what the final invoice would be, and they chose not to tell us they weren't going to pay, by advice of counsel, until the 30-day notice was up. Is the condo complex under obligation to compensate us for services performed over and above the contract payment schedule, even though we were the party to terminate the relationship? The termination was with good cause, although we didn't need any according to the contract terms. Thank you for your help.

Re: Compensation for services rendered following contract termination

You likely have bases for recovery either (i) under the terms of the contract itself, or (ii) under quasi-contract. You should consult with an attorney for advice specific to your contract.

Best wishes,
