Legal Question in Business Law in New Hampshire

Lien or collection?

I'm a contractor, in 15yrs this is a first. customer owes 18.5k. Basically she is crazy and does not want to sign the loan (he concurs he owes it and should pay). Is it best to lein which is easy or should I send to collection as I can obtain an intrest rate and attach collection fees where in NH that is not possible through a mechanics lein. I know the collection is negotiable and I give 30% to them as I use them for pittiful tenants. I guess the other option is sueing but then the lawyer agian will eat into the small 18k. Lawyers are the best but when the numbers get small or the end is unsure then one needs to think.

Re: Lien or collection?

You still have to file a lawsuit to perfect a mechanic's lien or to get a regualar pre-judgment attachment. You also cannot collect interest unless you have a written agreement to do so.
