Legal Question in Business Law in New Hampshire

I own a small business in NH and one of my clients is late on a payment. He is 15 days late so far and I have made 2 phone calls to him. I called one week ago and he told me that he would have a check in the mail by the end of the week. When I called today, I went straight to voicemail.

How do I take him to small claims court. The amount past due is $350.

Here is a link to the court web page dealing with small claims. It should provide most of what you need to move forward.

As a Franchise Attorney I think you should also consider a demand letter before taking an formal action. Being 15 days late, especially in this economy, is nothing. A demand letter may wake him up and not ruin a business relationship. Consult with a good business or franchise attorney in your area for specific advice.
