Legal Question in Business Law in New Hampshire
I used to work for a technology company in New Hampshire; I had signed a non competitive agreement when I joined the company.
I left my job a couple months ago and now would like to set up my own business that offers a similar solution as my previous employer offers.
I understand that this would probably violate my non-compete agreement. Is there a way around it? Please suggest if you have any ideas. What if I set up the company in a different country?
1 Answer from Attorneys
The specific terms of the non-compete agreement need to be examined. There are times where such agreements may be over broad and not enforceable. There are times where they are well drafted and you may not be able to set up the business you desire. You need to meet with an attorney to review the document and examine how it relates to the current status of the law in that area.
These types of agreements need to be viewed in light of just how restricitve they may be in preventing a person from earning a living. They have to be balanced in scope, duration and geographic area as necessary to protect a valuable interest of the employer.
