Condo Fees

I live in a condo and have gone through the by-laws many times. I have not found any amendments to the question I will ask. I have with-held condo fees because the by-laws are being broken. There have been no votes for officers. We are supposed to have a president, secretary and treasurer. The position of presidend and treasure are being held by one person who was given the position. He is spending money without clearing this through the assoc. He spent $750 on the drive being cleaned after the winter and they did not do this. Is is alright to with-hold fees and put them into an account?

Your better bet would be to hire a lawyer and sort through this to compel performance according to the bylaws.

The vote issue may not be sufficient breach of contract for you to withhold fees, if the person spending is entitled under his job description and powers to do what he's doing. The vote doesn't impact you directly, not really.

Further, you have an ongoing relationship with the association, so your better bet would be to force discussion of the issue in an overt way, rather than passively-aggressively trying to cause the association "pain" to force them to listen to you.
