Legal Question in Credit and Debt Law in New Hampshire

I cosigned for an auto loan for my 22 year old son to get a truck 3 year ago. A month ago he crashed and totaled the truck. Now there is a $6500 balance due to Chrysler after the insurance settlement and my son now says he will not pay it. I retired in March 2009 and can not afford to, but my son works for the state and makes $1000 a week and can. Is there a way I can get his wages garnished first before they try to make me pay?

Probably not. You are as liable on the debt as your son and the bank does not care which of you pays. You should talk to the bank first and let them know the situation. In either event, the bank would have to bring a lawsuit against you and your son to enforce the debt. If you end up paying anything to the bank you then have a claim against your son.
