Legal Question in Credit and Debt Law in New Hampshire

I loaned $35,000 to my niece. While there is no agreement setting forth the terms there are numerous e-mails acknowledging the debt. I established at the beginning a minimum payment of $50/month which was expected to increase. I have repeatedly asked them but so far nothing. Any action I could take besides writing a letter. Filing liens, legal action etc. I am in California they are in New Hampshire.

The success of any legal action will depend upon the content of the e-mails. Hopefully, when coupled together, they outline the basic terms of the loan---the amount, when regular payments due, interest rate and above all when expected to be paid in full. That information may allow you to obtain an attachment that would serve as security for the full payment. However, even that will depend upon whether there are any other liens recorded ahead of you.
