Legal Question in Criminal Law in New Hampshire

accept time instead of probation?

I have been on probation/counceling/drug testing for one year now.It will be over in 3 months. Last year I copied a drug script on a copy machine and gave it to two pharmacies. I got caught for both of them within two days of eachother. Unfortunately I had to get one lawyer for each case because one was in NH and one was MA. The NH case is coming up just as I am finishing my one year punishment from MA. I dont want to have another year or two of all this stuff. I want to know if it is possible to simply go to jail for two months and be done with it all. Meaning no probation, etc. Just the time. I have an interview with a p.o. who will interview me and give a recommendation to the court. Do I just simply tell him what I want? I want to get on with my life as a massage therapist. I want to have freedom to travel. I cant be calling a number everyday for the next three years to see if I have a drug test. If I went to jail would I also get probation and all the stuff? Or can I bite the bullet, spend two months in jail and put it all behind.

Re: accept time instead of probation?

The resolution that you propose is possible. It would be easier for your attorney to negotiate this resolution with probation and/or the prosecutor. You may be offering too much jail time if your record is not bad and the facts are not bad. As you know, to get the resolution you write of, you would have to plead guilty. Additionally, you may be able to do less time in consideration of a higher fine or other considerations. Obviously, all of the above depends upon the severity of your record and the facts of the two cases.
