Marijuana use and admission of use
If you are suspected of using marijuana and admit to using it but no proof is found that marijuana was present are you guilty of using it?

There is no criminal charge for using marijuana. The charge is for possession. If you are not found to be in the possession of marijuana then you can not be found guilty of possessing it. Martha Kovner

I think your question is too generic and you need to provide a little more detail about the circumstances to obtain a definitive answer.

usually an argument can be made that the confession should be suppressed because there is nothing to collaborate the confession. Such would depend upon the facts.
