Legal Question in Criminal Law in New Hampshire

recanting a statement

I made a statement to the police implicating my son and a friend. 30 hours later i recanted my statement. I was very stressed out and angry when I wrote it , and may have exaggerated the facts. Can that statement still be used against my son and his friend?

Re: recanting a statement

The statement will likely be used as a basis to charge or arraign your son and his friend. That said, your testimony, at trial, will be what is used to convict them. The fact that you recanted the statement will come into evidence and a jury will have to decide what weight to give to your two respective statements. You should work closely with their lawyers to ensure that the Prosecutor does not misrepresent your statements to the court or jury.
