Legal Question in Criminal Law in New Hampshire
Rights of accused shoplifter
While shopping in a sewing store, Helen, an alert 70-something seamstress, was at the button counter, where she produced from her purse a large blue button which she tried to match with other buttons on the display counter. None matched so she returned the large blue button to her purse and attempted to leave the store. She was detained by security when she refused to show the contents of her purse which was then forcibly taken and searched. She herself was also searched by security against her will and she was questioned for an hour, before being released. Can she sue?
