shoplifting

thank for your ans.no the lawyer that i talked with did not talk to the store..but he said that is what happens..the prosecutor tries and makes a deal..what kind of a deal does he make..

like a fine? or will he ask me to plead guilty to a lesser charge?if i do not want to plead guilty to even the lesser charge and the case goes to trial can i ask for the pre trial diversion program myself....can it be granted in light of my absolutely clean record? i live in Nashua.does it have this kind of a program (pre trial diversion program)

i really appreciate all the help.

The prosecutor can recommend any sentence he thinks is appropriate within the limits of the law, which could include a fine. If you are convicted after trial, you can't generally ask the judge for pre-trial diversion - that's solely within the discretion of the prosecutor. Off the top of my head I'm not sure what's available in Nashua but I suspect they have some alternative sentencing program available.
