Legal Question in Criminal Law in New Hampshire
my step daughter was pulled over in salem, NH for vehicle violation.. expired sticker. when she rolled down her window the cop said he smelt pot. they then searched her pocket book and found pot there. she was arrested. They let her go without any bail and charged her will possession and transporting.. also no field sobriety test or blood work done... is this something we should get a lawyer for or where she was wrong and had it should we save our money and plead guilty and take the fines..

I would strongly suggest hiring an attorney. You only get one bite at the apple and an attorney would be more apt to obtain a better result than if you try and handle it on your own. A guilty will follow her for the rest of her life.

Transportation of a Controlled Drug carries a mandatory court imposed license suspension of at least 60 days and up to 2 years. Possession of a controlled drug carries a license suspension imposed by the DMV rather than the court. There are other possible consequences including loss of college tuition.
In addition, the police must have a warrant or some exception to the warrant requirement to conduct the search of her purse. If not, then the evidence must be suppressed. If the evidence is suppressed it cannot be used in court and the case would be dismissed.
In these cases an attorney is essential to determine and protect your rights. Therefore, you should consult with a New Hampshire Criminal Defense Attorney.
