Wrongful Death

My son was murdered by his wife who shot my granddaughter and committed suicide. She had a will, my son did not. According to her will the godmother has temporary custody and is now asking for full custody and to be in charge of her trust. Granddaughter is ll yrs old.

The estate amts. to almost 1 million dollars. I am thinking of filing for wrongful death of my son who was shot in his sleep in Laconia, NH. How much time do I have to do this?

You should immediately retain counsel and petition for guardianship of any grandchildren; you have a natural relationship as opposed to the Godmother of your son's murderer. Filing of a lawsuit can only be brought on behalf of your son's estate; you will need to be appoiunted as his executrix (intestate probate) in order to have that authority. It may be possible to file a wrongful death claim on your own behalf as well depending on a set of circumstances.
