Legal Question in DUI Law in New Hampshire

Continued without a finding

Is it possible to get a continued without a finding in New Hampshire for a DUI. The prosecutor is offering 9 months loss of license reduced to 3 months after signing up for alcohol awareness classes and a reduction to a violation after 1 year of clean record. We would like to have this not on our sons record as a criminal offense is that what the reduction to a violation means? He has no previous criminal record.

It is highly unlikely to get the result you reference. Our statutes have a prohibiition against this type of arrangement. Depending upon all the facts and circumstances, there may be other alternatives, but I can offer no assurance. It would require a careful and detailed analysis of your son's case in order to evaulate options.

The offer made by the prosecutor is the minimum sentence. I did not see a fine included. Generally there is a $600 fine (including penalty assessment)

Also, if your son is of college age, there may be some exposure when applying for financial aid.
