Legal Question in DUI Law in New Hampshire

Criminal or not

My friend (he lives in MA) was convicted in DUI 1st offense in NH. His lawyers and several other lawyers whom we talked with said that DUI 1st offense is not criminal offense in the state of New Hamshire and will not appear in the criminal records. But now the lady from Impaired Driver Intervention Program says that 1st offense is criminal and should be presented in my friend's criminal records. The question is: who is right - lawyers or this lady?

Under NH law, a first conviction for a a DWI without a blood alcohol result in excess of .16, is considered a violation not a misdemeanor. A violation is not considered a crime under NH law.
